Obamacare Upheld – Constitution Trampled

28 June 2012 @ 20:18

The Supreme Court upheld, by a five to four margin, the Socialized Health Care Law known as Obamacare.

The decision may be found in PDF format here.  It is one hundred and ninety-three pages, with the Justice Scalia’s dissent starting at about page 128.

I will be offering an aggregation of the best analysis and commentary tomorrow, and my thoughts as well, but I want more time to read and think.

I would urge you all, however, to go to The Right Scoop and listen to Mark Levin’s commentary and analysis.  I’ve been listening to it and it is brilliant.

The first segments can be found here and the rest here.

It is time to move into the opposition, not opposition to either of the two major parties but opposition to the system itself.

Methinks you’re right. It’s interesting how others are beginning to mumble such things.

This is awful, we are screwed. Levin is great! This is a direct assault on all of us.
Taxed to death we are. I hope the good thing of this is that to repeal it, we repeal obummer in Nov.

And now there are no limits on how or to what purpose we may be taxed. Our descendants will rue this day, assuming they are still allowed to be told of such things.

I’m not sure Roberts didn’t do us a real favor. The first aspect of the ruling is that Congress’s efforts to justify ObamaCare through a further expansion of the Commerce Clause was slapped down hard. The Supreme Court finally said no to a Congress power grab. The second aspect is the Supreme Court told the administration and Congress that, yes, in point of fact this IS a tax on the American people and Congress surely has the power to impose taxes. Roberts in effect took a monster sized albatross named Tax Hike and hung it around the necks of Obama and all congressional ObamaCare supporters. Opponents should stop saying “healthcare/ObamaCare” and instead say “monstrous tax hike”.
