#BrettKimberlin D+5: In The Hedgerows [Updated Below]
-Just learned via Twitter that Megyn Kelly had a report on her Fox News show on SWATting [no video up yet, but keep checking the MK link]:

-Patterico has up a fine recap of what happened, as far as we know, to Aaron Walker yesterday, along with some good analysis. A highlight:
So Brett Kimberlin, knowing that Aaron was coming to court to defend against a civil “peace order,” lay in ambush with a criminal charge, so that Aaron would be arrested.
One wonders if this is his new strategy: he sues you for your blogging, and simultaneously obtains a peace order saying you harassed him. If you blog about him again, he gets a judge to rubber stamp a criminal complaint for violating the peace order.
Now, if you don’t show up for the lawsuit, he gets a default judgment. If you do, you get arrested for blogging.
Catch 22. And a nice scam if you can get judges gullible enough to go along with it.

Kimberlin knew how to use the system so that by the time Walker arrived in court on Tuesday, he had no idea there already was a warrant for his arrest.
‘Lying in wait’ is the appropriate term, I reckon.

The combination of frivolous civil and criminal actions is a creative abuse of process and it’s bound to be repeated — until judges start noticing that Kimberlin repeatedly makes false statements in the course of filing flurries of court actions against his critics.

Folks, this is how agitators do it. They agitate you, and then when you react, you are in trouble. I hope Aaron gets an attorney to overturn this travesty, and to reposition the case so that the true victim gets a court assistant.
Aaron Walker must get an attorney if he is to have any hope of receiving any justice.

That the left would celebrate such an ill-informed and frightening ruling is further proof that “progressivism” — for all its talk of fairness and protection for the little guy — is about nothing more than power and control. And any way they can seize it is fine with them, the ends justifying the means and all.– Which is why it isn’t at all unhelpful or “fundamentally unserious” to point out how and why progressives adopt a particular view of language and a particularly convenient anti-foundationalist epistemological stance: it is through the institutionalizing of the collectivist assumptions inherent in the left’s philosophical outlook (which is inherently egalitarian, and so inherently anti-liberty and, in the strictest sense therefore anti-American) that they’ve been able to lay the foundation for the normalizing of a postmodernist worldview, one in which Enlightenment principles are overthrown and replaced by a cheap relativism in order to reach an end stage where a mandate to rule is the product of coalition politics, a Balkanized society, and manufactured consent aided greatly by a compliant propaganda arm in the media.

-Over at American Power, Donald Douglas gives us a lesson on how to take some action [tip of the fedora to Mike G]:
I visited the district office of my congressman this morning, Representative John Campbell of California’s 48th Congressional District….
Rep. Campbell, a Republican, sits on the House Financial Services Committee. The committee’s jurisdiction extends to “all issues pertaining to the economy” and includes “efforts to combat terrorist financing.” And the committee oversees the Treasury Department, the cabinet-level agency which includes the Internal Revenue Service within its organization authority.
I spoke briefly with District Director Lou Penrose. I delivered to him a number of documents.
As Smitty comments:
Those living in districts with halfway useful Representatives are encouraged to follow Douglas’s lead.
If your representatives are useless, try contacting the people who work for any representative who you have donated to. They might listen.
If we shoot a thousand arrows into the air, a decent number will hit their targets.

…Destroying the Constitution, promoting the misapprehension of what it actually is and does, and neutering it as the bulwark of freedom, is a long-term project they’ve been diligently working on since the New Deal at least.
And they’ve been dismayingly successful, too–which is why, as Patterico now sees and I’ve been saying for a while now, this is NOT the United States of America. It is something else entirely. This is the fascist Left’s country now, in every way that truly matters, and has been for some time. The only way liberty-loving, Constitution-revering people can live in it is to limit to the greatest extent possible our contact with its officials, its administrators, its enforcement arm, and its bureaucracy. If we fail at that and run afoul of established authority in any way, we will find ourselves in one hell of a fine mess–as is always the case in any dictatorship.
