From David French, we learn [tip of the fedora to Instapundit][worth quoting at length]:

In the last 24 hours, my colleagues at the American Center for Law and Justice (ACLJ) have been in contact with literally dozens of tea-party organizations that have received intrusive information demands from the IRS, demands that seriously implicate their First Amendment rights. These information demands follow tea-party requests for 501(c)(3) or 501(c)(4) status and include questions like the following:

Do you directly or indirectly communicate with members of legislative bodies? If so, provide copies of the written communications and contents of other forms of communications.


Please describe the associate group members and their role with your organization in further detail. (a) How does your organization solicit members? (b) What are the questions asked of potential members? (c) What are the selection criteria for approval? (d) Do you limit membership to other organizations exempt under 501(c)(4) of the Code? (e) Provide the name, employer identification number, and address of the organizations.


Do you have a close relationship with any candidate for public office or political party? If so describe fully the nature of that relationship.

The quoted requests are merely the tip of the iceberg. We’re still reviewing the IRS letters and will have more information as we complete our review. Each of these questions — in their content, breadth, and vagueness — implicate the free-speech rights of the affected tea-party groups. Moreover, such intrusive membership requests also run afoul of NAACP v. Alabama and implicate their rights to freedom of association.

Critically, the demands we’ve seen are made not in response to complaints of wrongdoing but instead in response to applications for exemption. In other words, the IRS appears to be conditioning the grant of exemptions on the extensive violation of the tea-party groups’ fundamental First Amendment freedoms.

The politically aggressive Service Employees International Union (SEIU) has quietly created a national network of at least eight community-organizing groups, some of which function alongside the Occupy Wall Street movement, a Daily Caller investigation shows. Incorporated by the SEIU as local non-profits, the groups are waging concerted local political campaigns to publicly attack conservative political figures, banks, energy companies and other corporations.

Each local group has portrayed itself as an independent community organization not tied to any special interest. But they were founded, incorporated, and led by SEIU personnel.

The individual activist groups use benign-sounding names including This Is Our DC; Good Jobs, Great Houston; Good Jobs, Better Baltimore; Good Jobs Now in Detroit; Fight for Philly; One Pittsburgh; Good Jobs LA; and Minnesotans for a Fair Economy.

In reality, they are creations of the wealthy and influential labor union, amounting to a secret network of new SEIU front groups.

Why has the Left spent the past five days ginning up a ridiculous controversy over Rush Limbaugh’s use of the word “slut” to describe liberal liar Sandra Fluke? Is it possible that they’re trying to distract attention from their own shady activity? Michelle Malkin is not distracted:

In a scathing fundraising e-mail appeal, Obama campaign manager Jim Messina name-checked wealthy free-market philanthropists Charles and David Koch — along with a growing movement of grassroots conservatives who have freely, voluntarily and legally given money to the Koch-founded nonprofit activist group Americans for Prosperity and its sister foundation. . . .

The threat of scrutiny was backed by Obama himself, whose official campaign Twitter account directed 12 million-plus followers this week to “add your name to demand that the Koch brothers make their donors public.”

Did you catch that? The President of the United States used his official Twitter account to attack the Koch brothers and Americans for Prosperity, a move that is clearly part of a coordinated effort by left-wing activists (including Occupy Wall Street and their union-thug allies) to smear and intimidate their political opponents.
