Who Is Elena Kagan?

Some observations…

-She is most certainly not John Galt [I figured I’d just get that one out of the way right at the start instead of letting it be the 900lb looter in the room (Rare Objectivist humor!)].

-I don’t care about what her sexual preference is as long as she doesn’t allow it to influence her opinions as an Associate Justice of the SCOTUS.

-As for her never having has any experience as a judge, I must disagree with my Friends In The Ether who think this matters.  John Marshall had never served as a judge before John Adams appointed him Chief Justice and he did pretty damn well as the CJ of SCOTUS.  It might actually be a mark in her favor because it means she’s not part of that closed and stuffy little world.

-Watching the Left’s behavior in regard to Mzz. Kagan’s sexual preferences has been quite fun.

-Stacy McCain’s latest postings on the subject have been enlightening, informative, and enjoyable.

-Regarding her actions at Harvard in the ROTC matter, I’m with Smitty 100% [see here (love the post title 1E, but, then again, I would), here, and here].  Some tough questions have to be asked of her on this matter.

This posting by Gator Doug on what seems to be her views on the Second Amendment are very, very disturbing.

-Perhaps the most disturbing thing of all are her views on Freedom Of Speech.  Contained in a brief filed in the case of U.S. v. Stevens that she signed is this statement:

Whether a given category of speech enjoys First Amendment protection depends upon a categorical balancing of the value of the speech against its societal costs.

As Mark Steyn points out:

“Balancing” is the code word there. Canada’s thought police are all about the “balancing“.

Over at WyBlog, Chris offers these spot-on remarks:

…In Elena Kagan’s America the right to not be offended trumps your right to free speech. The right to criticize your government must be weighed against the “societal cost” of that criticism. Who will do the weighing? Why Elena Kagan of course! She won’t be merely a Justice of the Supreme Court, she’ll be the High Priestess of Censorship!

-Final Observation: no matter how ‘moderate’ she may be on certain issues, it appears that Elena Kagan is a typical Leftist when it comes to matters concerning The Constitution.  As such, she can be expected to not rule impartially because the Leftist does not believe in such a convention.  ‘By any means necessary’ is their main operating order.

-This is worth a fight, Wolverines.

On a lighter note: there has been much debate, as there always is in these situations, as to who Elena Kagan really is.

-Over at Viewed From The Right, Lipton T. Bagg offers his theory: It’s Pat!

Richard, I’m forced to say that Lipton looks to be closer to the truth.

However, I may have stumbled upon the whole truth and nothing but the truth as to who is Elena Kagan:

    Kagan may or not be as bad as someone else Obama might nominate but she’ll be there for at least 30 yrs. Unacceptable must filibuster, we need the party of hell no not the party of let’s talk about it. Her actions as Harvard Dean were deliberately illegal. If in her view a mere Harvard Dean has the right to nullify laws she personally disagrees with imagine the latitude she feels a Liberal Supreme Court Justice is entitled to.
